Terms of Service

1. Acceptance of Terms

By downloading, installing, or using GymProof (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legal agreement between you and GymProof ("we," "us," or "our").

We reserve the right to update these Terms at any time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use GymProof. By using the App, you represent and warrant that you meet this requirement.

3. Account Registration

To access certain features you must create an account. You agree to:

  • Provide accurate and complete registration information.
  • Keep your password secure and confidential.
  • Notify us immediately of any unauthorized use of your account.
  • Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

4. Description of Service

GymProof is a GPS-based gym session tracking application that:

  • Automatically detects your arrival at and departure from registered gym locations using geofencing technology.
  • Records workout sessions and calculates points, streaks, and other gamification metrics.
  • Provides optional Pro subscription features including unlimited gyms, enhanced points multipliers, streak shields, cross-device sync, and ad-free experience.

We may modify, suspend, or discontinue any part of the service at any time with reasonable notice where practicable.

5. Location Permission

GymProof requires background location access to detect gym sessions automatically. By granting this permission, you consent to the collection and processing of your location data as described in our Privacy Policy. You may revoke location permission at any time in your device settings, which will disable automatic session detection.

6. Subscriptions and Payments

6.1 Free Tier

GymProof is free to download and use with a limited feature set, including one registered gym and ad-supported experience.

6.2 GymProof Pro

GymProof Pro is available as a monthly subscription, annual subscription, or one-time lifetime purchase. Prices are displayed in the App and are subject to change.

6.3 Billing

All payments are processed through the Apple App Store or Google Play Store. Your subscription will automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can manage and cancel your subscription in your device's App Store / Play Store account settings.

6.4 Refunds

Refund requests are handled by Apple or Google according to their respective refund policies. We do not process refunds directly. Lifetime purchases are non-refundable except as required by applicable law.

6.5 Price Changes

We may change subscription prices with advance notice. Continued use after a price change takes effect constitutes your acceptance of the new price.

7. Acceptable Use

You agree not to:

  • Attempt to reverse-engineer, decompile, or extract the source code of the App.
  • Use the App to transmit spam, malware, or harmful content.
  • Attempt to gain unauthorized access to our systems or other users' accounts.
  • Manipulate or falsify session data, points, or streaks.
  • Use the App in any way that violates applicable laws or regulations.
  • Resell, sublicense, or commercially exploit the App or its content without our written permission.

8. Intellectual Property

The App and all its content — including but not limited to text, graphics, logos, icons, and software — are the exclusive property of GymProof and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

9. User Content

You retain ownership of any content you submit (e.g., gym names, profile information). By submitting content, you grant us a worldwide, royalty-free license to use, store, and display it solely for the purpose of operating the App. You represent that your content does not infringe any third-party rights.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

GymProof does not guarantee that session detection will be 100% accurate — GPS accuracy and device background processing restrictions may affect detection. We are not responsible for missed or incorrect session records.

GymProof is not a medical or fitness advice application. Consult a qualified healthcare professional before beginning any exercise program.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GYMPROOF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability to you shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) $10 USD.

12. Indemnification

You agree to indemnify and hold harmless GymProof and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the App, your violation of these Terms, or your violation of any third-party rights.

13. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms, without prior notice where we deem it necessary. Upon termination, the license granted to you under these Terms will immediately end.

14. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes will be resolved in the courts of competent jurisdiction. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
